Collective Conflict Resolution: López Campillo Firm Restores Auto Parts Production After an Illegal Strike

In an unexpected turn of events that threatened the stability of our client, a company dedicated to manufacturing auto parts and a Tier 1 supplier for one of the world's largest automakers, a group of employees staged an illegal strike, disrupting operations. The main cause of dissatisfaction was the payment of profit sharing (PTU), which triggered a series of events that directly impacted production.


The second shift, consisting of 24 key workers, was affected, causing chaos within the facilities. They took control of the loading ramps, preventing the shipment and delivery of auto parts to the OEM. The consequences were alarming: production came to a halt, resulting in significant financial losses due to contractual penalties and the failure to deliver products.


Faced with this critical situation, our client sought our intervention. Working closely with state authorities, including the Ministry of Labor and the Labor Conciliation Center, we embarked on a comprehensive legal strategy to restore order and resume production.


We exhausted all avenues of conciliation through effective dialogue with the workers, successfully persuading some of them to return to work. As for the workers with whom an agreement could not be reached, administrative records were created, and formal notifications of termination of employment were issued by a notary public. Additionally, we filed criminal complaints against the employees responsible for the financial damages caused to the company.


Thanks to the tenacity and collaborative efforts of our legal team, operations were normalized, and auto parts production resumed. The positive impact of our intervention extended not only to our client but also to the automaker and its thousands of employees in northern Mexico.

En un giro inesperado que amenazó la estabilidad de nuestro cliente, una firma dedicada a la fabricación de autopartes y proveedor Tier 1 para una de las armadoras más importantes del mundo, un grupo de colaboradores llevó a cabo un paro ilegal de operaciones. El motivo principal de inconformidad era el pago del PTU, lo cual desencadenó una serie de eventos que impactaron directamente la producción.


El segundo turno de labores, compuesto por 24 trabajadores clave, se vio afectado, provocando un caos en las instalaciones. Tomaron las rampas de embarque, impidiendo la salida y entrega de autopartes al OEM. Las consecuencias eran alarmantes: la producción se paralizó, lo que resultó en pérdidas financieras significativas debido a penalizaciones contractuales y la falta de entrega de productos.


Ante esta situación crítica, nuestro cliente solicitó nuestra intervención. Trabajando en estrecha colaboración con las autoridades del estado, incluyendo la Secretaría del Trabajo y el Centro de Conciliación Laboral, nos embarcamos en una estrategia legal integral para restablecer el orden y reanudar la producción.


Agotamos todas las vías de conciliación mediante dialogo efectivo con los trabajadores, logrando que algunos de ellos se reincorporaran al centro de trabajo. Con respecto de los trabajadores con los que no se logró un acuerdo, en consecuencia, se levantaron actas administrativas y se procedió a la notificación de la rescisión de la relación laboral ante un fedatario público. Además, presentamos denuncias penales contra los colaboradores responsables de los daños patrimoniales ocasionados a la empresa.


Gracias a la tenacidad y la labor conjunta de nuestro equipo legal, se logró normalizar las operaciones y reanudar la producción de autopartes. As co-defendants in a damages lawsuit, our esteemed client, a renowned auto parts manufacturer and Tier 1 supplier to major vehicle manufacturers in Mexico, faced a legal challenge under the jurisdiction of Mexico City. Recognizing the importance of conducting legal proceedings within the jurisdiction where their production plant is situated, our client sought our firm's defense and assistance in managing the lawsuit. With a focus on safeguarding our client's interests, we filed a motion to declare lack of jurisdiction, seeking the transfer of the case to the competent judge in their home state, a key hub for vehicle production in northern Mexico. Despite the initial rejection by the Mexico City judge, we persisted and appealed the ruling. Our unwavering determination and compelling arguments yielded success, as the appeal was granted, and the Mexico City judge was declared incompetent. Consequently, the case was transferred to the state of Coahuila, where our client's operations are based. This legal victory brought about significant advantages for our client: Cost reduction: By transferring the lawsuit to the local jurisdiction, substantial cost reductions associated with litigating in a distant location were achieved. Appropriate litigation venue: Compelling the plaintiff to litigate in Coahuila instead of Mexico City enabled our client to face the trial in a familiar environment near their production plant, where they possessed a better understanding of the local legal system. Streamlined evidence presentation: The transfer of the lawsuit facilitated our client in presenting and substantiating their evidence with greater ease, eliminating potential logistical obstacles due to their geographical proximity. Enhanced control of the trial: Operating within their local jurisdiction, our client enjoyed improved control and supervision over the judicial process, ensuring more effective legal representation and a robust defense.
